The Appellate component of the unit handles all post-conviction matters stemming from convictions in Superior Court, including, but not limited to, motions for new trial, appeals to the Georgia Court of Appeals and the Supreme Court of Georgia, and motions to modify sentence.  Additionally, petitions for habeas corpus relief filed by prisoners incarcerated within Clayton County’s penal institutions are also handled. 

 

The Asset Forfeiture component reviews and prosecutes requests from law enforcement to forfeit seized property based upon that property having been involved with criminal activity.  Most commonly, forfeited property consists of currency, vehicles, and other instrumentalities of the illegal drug trade.
